Juan Casulá Oliver, Attorney

Casulá has been practising law for more than 25 years, advising in national and international lawsuits on patents, trademarks, unfair competition, advertising, intellectual property and related rights. He focuses on legal actions involving infringement, nullity, preventive writs, preliminary injunctions, pre-trial proceedings to collect evidence, as well as on criminal and contentious-administrative proceedings. He has also handled numerous appeals filed with Appeal Courts (Audiencias Provinciales), the National High Court (Audiencia Nacional), the Spanish Supreme Court, the Spanish Constitutional Court and the Court of Justice of the European Union. Additionally, he has brought cases before the Spanish Securities Market Commission (CNMC), Association for Commercial Self-Regulation (Asociación de Autocontrol de la Publicidad), Spanish Directorate General for Customs, European Union Intellectual Property Office (EUIPO) and Spanish Patents and Trademarks Office (OEPM).

Casulá specialises in negotiations and preparing all types of agreements, especially licensing agreements for patents and trademarks, transfers of technology and know-how, valuations of intangible assets, protection of trade secrets and business confidentiality, coexistence of distinguishing features, distribution, franchises and assignment of intellectual property.

He is an active member of the Madrid Bar Association (ICAM) and Grupo Español de la AIPPI (Asociación Internacional para la Protección de la Propiedad Industrial e intelectual).

He has taught at the Escuela de Práctica Jurídica COLEX, Instituto de Empresa (IE), Boletín Oficial del Estado (BOE) as well as a practicum on patent law in the Magister Lvcentinvs at Universidad de Alicante.

Casulá is co-author of a chapter on the legal protection of trade marks in Factbook: propiedad industrial (Aranzadi) and several chapters on patent law in the Big Data encyclopaedia (ISDE).

He earned his law degree from the Universidad Autónoma de Madrid. He also holds two-year degrees in specialised training for lawyers and in labour law from the Escuela de Práctica Jurídica at Universidad Complutense de Madrid.
